New Delhi:
A tribunal in this city has given a man a 12-year harsh imprisonment sentence for sexually assaulting an 80-year-old bedridden woman in 2022, stating that the incident was a “strike against societal and ethical principles”.
Taking into account the account of the survivor that she begged the 30-year-old culprit with folded hands beseeching him to spare her, the tribunal observed that the wrongdoer committed the deed solely to gratify his desires.
Add-on Sessions Magistrate Aanchal of Tis Hazari district courts was overseeing the lawsuit against Ankit alias Mogli, who was found guilty of the criminal acts of sexual assault, home intrusion, robbery, and voluntarily causing harm.
As per the prosecution, Ankit infiltrated the residence of the survivor, who was confined to bed due to non-operational lower extremities. He then assaulted her, sexually assaulted her repeatedly, and fled after pilfering her mobile phone, it stated.
“Beyond question, sexual assault is one of the most atrocious crimes that debases and desecrates the spirit of the victim. It crushes the individuality and self-assurance of the survivor but the offense here has also struck against societal and ethical principles,” it appended.
The court affirmed that there was no proof to indicate that the crime was perpetrated impulsively or out of any necessity. Alternatively, the details of the case demonstrate that the perpetrator committed the offense “solely to gratify his sexual desires where the victim was exploited as a tool.” It gave him a 12-year harsh imprisonment sentence for the act of sexual assault after taking into account the mitigating and aggravating factors, the culprit’s age, family obligations, and his chances of being reformed.
The tribunal also handed him a five-year imprisonment term for home intrusion, one year for committing robbery, and six months for causing harm.
The sentences will be served concurrently, it stated.
The tribunal also directed the case to the Delhi State Legal Services Authority (DSLA) to ascertain appropriate compensation for the survivor.
